Recruiting and Hiring Privacy/Data Protection Notice​​

This Notice is effective December 14, 2018.

Unisys Corporation and its subsidiaries around the world (Unisys or we) respect your privacy. It is necessary for Unisys to collect certain personal data from you in order to perform our obligations under the law, consider your application for employment with us and onboard you as an employee of Unisys if we offer you a position with us.

This notice provides you with information about the type of data we collect, why we collect it, with whom we share it and how we protect it during the recruiting and hiring process.

This notice does not form part of any contract of employment should you be offered employment by us and does not cover the handling of our employee personal data. We cover the collection and processing of employee personal data through internal policies, processes and notices.

Who are “We”

When you submit your personal data to Unisys, both Unisys Corporation and the Unisys subsidiaries offering the role that you are applying for as well as other Unisys subsidiaries where your future managers or other superiors are located will receive and use your information as described in this notice.

What Personal Data We Collect and Process

We collect and process personal data about you in several different ways as described below. In some instances, we process your personal data based on your consent. We also process personal data you provide to comply with laws and regulations and ensure we operate as a compliant company. If you are hired, we will use the personal data you provide to perform the employment contract with you.

You may choose to register with our applicant tracking system or provide information to one of our recruiters in order to receive information about new job postings, make inquiries about job openings or apply for a position with Unisys. Some of the information we request and collect is required by law.

When you do, we will collect the following types of personal data:

i. Name,

ii. contact information (physical address, e-mail address(es), telephone number(s)), and

iii. other identifying data required by applicable laws.

You may also provide us with additional information about yourself including, for example, education, work history and references. After you register in our applicant tracking system, you will be asked to upload a prepared CV or build a CV using skills fields or, if you so choose, import information from your social media account. If you do, we require you to provide certain information.

The personal data and information we request and that you voluntarily choose to provide will depend on the job you are seeking. If you do not provide the information required, we may be unable to process your application.

Unless requested for a specific legal obligation, you should not provide data relating to your:

i. racial or ethnic origin;

ii. political opinions;

iii. philosophical or religious beliefs;

iv. membership of a trade union or political party;

v.  physical or mental health;

vi. sexual life or sexual orientation; or

vii. criminal convictions or offences.

If you provide us with personal contact information about another person, for example, for providing a reference or job referral, it is your responsibility to ensure that the person is aware and consents to you providing his/her contact information.

If you are hired, may also collect and process your personal data related to your professional skills and experience.

We may also receive personal data from third parties. For example, if you have been hired through a third-party staffing or recruiting firm, we will receive Personal Details and information on your experience and qualifications. Referees also provide personal data to us. Where permitted or otherwise authorized by law, information received from third parties may include the results of background checks.

How We Use Your Personal Data

We use the personal data you provide to:

  • manage your registration in our applicant tracking system;
  • communicate with you about the recruiting and hiring process, set up and conduct interviews and assessments;
  • conduct background checks, as required or legally permitted by applicable local law;
    process your job application;
  • conduct onboarding activities if you are offered a position, such as issuance of a badge, training, assignment of equipment and access to systems;
  • comply with legal requirements; and
  • operate and improve our applicant experience that may include sending you a survey about your experience.

If you are hired, we will use your personal data for onboarding, including to set up necessary business processes for your employment with Unisys such as payroll, training, benefits, administration of your participation (if any) in share-based or other incentive plans offered by Unisys, expense reimbursement, performance management, company directory listing, access to company facilities and facilities of our clients and other third parties, network and applications.  We may also use your personal data to provide resource capabilities when responding to client proposals, share specific qualifications with a client when required or help deploy you on client work.

Where required by law, we provide aggregated statistics about candidates using the personal data you submit. These statistics are anonymous.

With your consent, if you are not hired for the first position to which you apply, we may retain and consider your data obtained through the application process for other job openings with Unisys.

At all times, we will process your personal data fairly and lawfully. We will handle candidate personal data in accordance with this notice unless it conflicts with stricter requirements of applicable law in which case applicable law will prevail.

How We Protect Your Personal Data

We use reasonable security procedures to protect against unauthorized or unlawful access, processing, disclosure, alteration, destruction or accidental loss of your personal data.

We limit access to and use of your personal data to authorized persons and trusted third parties who have a reasonable need to know the information in order to perform our business operations and who are bound by confidentiality obligations.

When your personal data is no longer needed, we will securely destroy or anonymize it.

How Long We Retain Personal Data

We retain your personal data only for as long as is necessary to fulfill the purpose for which the data was collected from you and in consideration of and compliance with applicable legal or regulatory requirements to maintain the data for legitimate purposes. For example, where required by law for audits or accounting requirements, to enforce our agreements or handle disputes.

With Whom We Share Your Personal Data

We are a global enterprise headquartered in the United States with operations in countries around the world. As part of our recruitment and hiring practices, we will share your personal data with authorized Unisys Corporate and subsidiary human resources personnel as needed, as well as third parties who are acting on our behalf, namely those who:

i. perform recruiting services such as employment reference checks, interview scheduling, application tracking, and employment screenings;

ii. perform hiring services such as onboarding, payroll, training and benefits administration;

iii. provide IT services, such as hosting and cloud providers; and

iv. administer participation of our employees in share-based or other incentive plans, which may be offered by Unisys Corporation.

These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf pursuant to a contractual obligation or to comply with legal requirements. Unisys requires such third parties to comply with applicable data protection and privacy laws and agree to implement and maintain appropriate technical and organizational security measures to safeguard the personal data.

In addition, we may disclose your personal data to lawyers, professional advisors, courts, tribunals, opposing or other related parties to legal or administrative proceedings and their professional advisors:

i. if we are required to do so by law or pursuant to legal process;

ii. in response to a request from law enforcement authorities, other government officials (including for national security purposes) or securities or other regulatory authorities in countries in which Unisys securities are listed or traded;

iii. for our legitimate interests, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual fraud or illegal activity;

iv. when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others; or

v. in connection with the sale, transfer or financing of all or part of a Unisys business or its assets, including any such activities associated with a bankruptcy proceeding.

In addition, we may disclose your personal data to our client’s, client’s clients and other third parties in order to perform background checks and grant you access to their facilities.  We may also share your resume, if you have provided one to us, with clients for other legitimate business reasons, such as a request for a particular resource or in response to a client RFI or RFP requesting to submit resume information for the services to be provided to the client. We will seek to anonymize the resume before sharing with our client, unless our clients or the relevant RFP obliges us to share your name. We require such clients to respect the security of your personal data and to treat it in accordance with applicable data protection laws. We do not allow our clients to use your personal data for any other purposes than evaluating if your resume meet the client’s criteria. We will require that all our clients comply with data privacy laws if they require such information for clearance processes in compliance with the law.

We Transfer Your Data Across International Borders

We and/or our third-party providers will process, view and maintain your personal data in the United States. In addition, we may process, view and maintain personal data submitted by you in a country that is different from the country where you submitted the personal data. For example, your information may be accessed by a subsidiary of Unisys for a particular job opening in a country different from where you are located.

As an IT and security services company, Unisys has implemented global privacy practices for processing personal data protected under various data protection laws. Unisys transfers personal data between the countries in which we operate in accordance with the standards and conditions of applicable data privacy laws.

For applicants residing in the EU, EEA or Switzerland

When transferring your personal data outside the EU, EEA and Switzerland, Unisys relies on Standard Contractual Clauses (SCCs) approved by the EU Commission, and verifies the adequacy of personal data protection in the recipient country. Personal data from the EU, EEA and Switzerland is transferred to the U.S. for purposes of administering the recruiting/hiring relationship. With regard to recruiting and hiring personal data that is transferred from the EU, EEA or Switzerland to the U.S., Unisys complies with the EU Commission approved SCCs regarding the collection, use, and retention of personal data transferred from the European Union or Switzerland to the United States. If there is any conflict between the terms in Unisys’ Recruiting and Hiring Privacy/Data Protection Notice and the SCCs, the SCCs shall govern.

On July 16, 2020 the Court of Justice of the European Union invalidated the adequacy finding for the EU-U.S. Privacy Shield. On September 8, 2020 the Swiss Federal Data Protection and Information Commissioner followed suit, issuing an opinion paper stating the Swiss-U.S. Privacy Shield did not provide an adequate level of protection for data transfer from Switzerland to the U.S.

While the Privacy Shield Framework may no longer be relied upon, Unisys has self-certified and will continue to comply with the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks. Unisys will continue to be subject to Federal Trade Commission enforcement and investigatory powers and regulation by the Department of Commerce until such time as a Privacy Shield replacement is enacted for EU-U.S. data transfers. In compliance with the Privacy Shield Principles, Unisys commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Unisys as provided for below under “How To Contact Us.”

Under certain circumstances, you may be able to invoke binding arbitration. In accordance with Privacy Shield, Unisys has further committed to refer unresolved Privacy Shield complaints to JAMS Privacy Shield Dispute Resolution, an alternative dispute resolution provider located in the [United States]. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please visit File An E.U.-U.S. Privacy Shield or Safe Harbor Claim JAMS for more information or to file a complaint. The services of JAMS are provided at no cost to you.

When we receive written complaints submitted by applicants, we will follow up with the person who made the claim. If you have a complaint or concern, please contact us at: unisysglobalprivacy@unisys.com and we will attempt to resolve it. In the event that we are unable to resolve your complaint or concern, Unisys commits to cooperate with the panel established by the EU supervisory authorities (formerly called data protection authorities) or the Swiss Federal Data Protection and Information Commissioner and comply with the advice given by the panel or Commissioner with regard to personal data transferred from the EU or Switzerland in the context of the recruiting/hiring relationship.

Please see below regarding your rights to limit the use and disclosure of your personal data, where applicable. At any time, you may contact us at unisysglobalprivacy@unisys.com to inquire about limiting the use and disclosure of your information. Unisys may disclose personal information in special cases when we have a good faith belief that it is necessary to conform to legal requirements or to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.

How to Access and Correct Your Personal Data

We rely on you to provide accurate, complete and current personal data to us.

If you need to correct or update the personal data you provided to us, you can log into our applicant tracking system from the Careers site and add, correct or modify your personal data with the options provided. If you need assistance or want to request your data be removed from our applicant tracking system, please contact us through globalrecruiting@unisys.com or unisysglobalprivacy@unisys.com. We will respond in a timely manner to all reasonable requests to access, correct or delete your personal data.

Rights for Applicants Residing in Brazil and the EEA

If you are residing in Brazil or the EEA when you apply, you have the following rights:

i. Access - You have the right to obtain confirmation from us if we are processing your personal data.

ii. Rectification - You have the right to request that we correct inaccurate personal data and to have incomplete data completed.

iii. Objection - You have the right to object to the processing of your personal data for compelling and legitimate reasons relating to your particular situation and we will comply except in cases where legal provisions expressly provide for that processing.

iv. Portability - In limited circumstances, you may receive your personal data that you have provided to us, in a structured, commonly used and machine-readable format. This only applies if the processing is based on your consent or a contract and the processing is carried out by automated means.

v. Restriction - You may request to restrict processing of your personal data if (i) you contest the accuracy of the data – for a period we need to verify your request; (ii) the processing is unlawful and you oppose the erasure of the data and request restriction instead; (iii) we no longer need the data, but you tell us you need the data to establish, exercise or defend a legal claim; or (iv) you object to processing based on public or legitimate interest – for a period we need to verify your request.

vi. Erasure - You may request to erase your personal data where there is no compelling reason for its continued processing.

vii. Right to lodge a complaint - You also have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your residence, place of employment, or the location where the issue that is the subject of the complaint occurred.

viii. Right to refuse or withdraw consent - Please note that in case we ask for your consent to processing, you are free to refuse to give consent and you can withdraw your consent at any time without any adverse negative consequences. The lawfulness of any processing of your personal data that occurred prior to the withdrawal of your consent will not be affected.

Additional Rights for Applicants who reside in Brazil

Right to anonymization, blocking or elimination - you may request the anonymization, blocking or elimination of unnecessary or excessive personal data or personal data which is not in compliance with LGPD provisions.

Right to review automated decisions - you may request a review of automated data processing decisions that affect your personal interests, including when intended for the purposes of developing personal, consumer and credit profiles and/or personality aspects.

If you consider that the way we process your personal data infringes your rights under the GDPR or is not compliant, you can lodge a complaint with Unisys directly or with a supervisory authority in the EU Member state in which you reside or where the data was processed.

Cookies and Other Data Tools

When you visit the Unisys recruiting website, we or our third-party service providers may collect information through the use of cookies or other device identification tools. The cookies we and our service providers’ use are unique to you and can only be read by our or our third-party service providers’ web servers. These tools perform different jobs, like letting you navigate between pages efficiently, remembering your preferences, and improving your overall experience. Contractors of Unisys

Unisys respects the privacy of our contractor’s data.  As such, this notice applies equally to the collection and use of contractor personal data as it does for candidate and Unisys associate personal data.
